1.1 These General Terms and Conditions (\u201cGTC\u201d) apply to all contracts concluded between you as the customer (\u201cyou\u201d) and the company nacani GmbH (\u201cnacani\u201d) as the operator of the online store at www.nacani.de (\u201cnacani webshop\u201d). As part of the ordering process, you accept the GTC in the version valid at the time the order is placed. Deviating or supplementary general terms and conditions of the customer shall only apply if nacani has agreed to them in text form in individual cases.<\/p>\n

2.1 The presentation of the products in the webshop does not constitute a binding sales offer. The goods you select are initially collected in a virtual shopping cart. Goods in the shopping cart are not reserved for you and can be purchased by other customers in the meantime. After entering your contact details, payment and shipping information, you submit a binding purchase offer by clicking on the order button. Before doing so, you have the opportunity to check your details and, if necessary, change them or correct any input errors. Your binding order can only be sent if you have expressly accepted these GTC. The offer to conclude a purchase contract is made by you as the customer by clicking the [Submit order] button.<\/p>\n

2.2 Confirmation of receipt of your order will be sent by an automated e-mail immediately after you have sent your order; this does not constitute acceptance of the contract by nacani, but is for your information only.<\/p>\n

3.1 The delivery period begins as soon as full payment of the purchase price has been received. Your order will be prepared for dispatch and sent to you within two to three working days after receipt of the purchase price.<\/p>\n

3.2 After your order has been shipped, you will receive an e-mail with a tracking number that you can use to track your order online.<\/p>\n

3.3 If an ordered product is not available, nacani may refuse your purchase offer. 4 Prices, shipping costs, customs duties<\/h2>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

4.1 The final prices stated in the webshop include the statutory value added tax. The prices quoted for deliveries to EU countries include the VAT applicable in Germany.
Prices for deliveries to countries in the European Union (\u201cEU\u201d) are quoted in euros (EUR). Any refunds will also be made on the basis of the original payment made by you without taking into account changing exchange rates.<\/p>

4.2 The purchase price is due immediately upon conclusion of the contract.<\/p>

4.3 Delivery costs<\/p>

Germany<\/strong>
Standard (3-5 working days): 4.60 Euro, from 100 Euro order value the order is free of delivery costs.<\/p>

Austria<\/strong>
Standard (3-5 working days): 10.70 euros, from 200 euros order value the order is free of delivery costs.<\/p>

EU countries<\/strong>
Standard (3-5 working days): 11.45 – 14.50 euros, varies depending on the country. Orders over 200 euros are free of charge.<\/p>

4.4 When shipping to non-EU countries, your order may incur additional taxes and costs (e.g. customs duties), which cannot be paid by us or invoiced by us, but must be paid by you directly to the relevant customs or tax authorities. 5.1 We only accept the payment methods that are displayed when you place your order: Credit card payments with VISA and MASTERCARD, payment by PAYPAL and SOFORT\u00dcBERWEISUNG, direct bank transfer or SEPA direct debit.<\/p>\n

When paying by SOFORT bank transfer, payment is processed by SOFORT GmbH, Fu\u00dfbergstra\u00dfe 1, 82131 Gauting, Germany.<\/p>\n

If you pay by credit card or another payment method where your account is not held in the currency specified at the time of purchase, your account will be debited on the basis of the exchange rate applicable at the time the transaction is settled by your card provider or payment service provider and determined by them.<\/p>\n

Your PayPal payment will be processed by PayPal (Europe) S.\u00e0 r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg. The respective terms and conditions of the contractual partners apply. If you pay with PayPal, you will be redirected to the PayPal page at checkout, where you can log in and complete the payment process. As soon as payment has been made, you will be redirected back to nacani.<\/p>\n

All transactions on this website are processed via STRIPE. This is a secure online payment portal where your payment details are encrypted in a secure host environment.<\/p>\n

nacani GmbH also offers you the option of saving your credit card details so that you can shop with us more quickly and easily. Your credit card number is not displayed in full – only the last four digits are visible. This allows you to quickly and easily identify which of your credit cards you are using. You can delete your credit card details at any time by deactivating the \u201cSave my payment methods\u201d function on the payment page.<\/p>\n

Please note that you will need to re-enter your credit card details if you wish to change your existing addresses or add new ones. This is to protect your personal data from third parties.<\/p>\n

5.2 The delivered goods remain the property of nacani until full payment has been made<\/p>\n

5.3 During transportation, your order is insured by nacani until the time of delivery. Upon delivery and signature, the liability for the purchased items is transferred to you. 6 Statutory right of withdrawal \/ returns<\/h2>\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

6.1 Consumers have a statutory right of withdrawal when concluding a distance selling transaction, about which nacan informs in accordance with the statutory model below.<\/p>\n

\nYou have the right to withdraw from this contract within fourteen days without giving any reason.<\/p>\n

The revocation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the goods. If you have ordered several goods as part of a single order and these goods are delivered separately, the withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, have taken possession of the last goods.<\/p>\n

To exercise the right of withdrawal, you must inform us (nacani) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail).<\/p>\n

To comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.<\/p>\n

Exclusion of the right of withdrawal<\/strong><\/p>\n

Packages that have already been opened cannot be returned unless there is a clear product defect.<\/p>\n

Consequences of withdrawal<\/strong>
\nIf you withdraw from this contract, all payments that nacani has received from you, including the delivery costs (with the exception of any costs resulting from the fact that you have chosen a different type of delivery than the cheapest standard delivery offered), will be refunded to you immediately and at the latest within fifteen days from the day on which we receive the revoked goods. This refund will be made using the same means of payment that you used for the original transaction, unless expressly agreed otherwise; under no circumstances will you be charged any fees for this refund. Repayment may be withheld until nacani has received the goods back or until you have provided proof that you have returned the goods, whichever is the earliest.<\/p>\n

You must return or hand over the goods immediately and in any case within fourteen days at the latest from the day on which you inform nacani of the revocation of this contract. The deadline is met if you send the goods before the period of fourteen days has expired.<\/p>\n

You bear the direct costs of returning the goods. The return must be insured and trackable when sent back to nacani. You are only responsible for any loss in value of the goods if this loss results from handling beyond what is necessary to inspect the condition, properties, and functionality of the goods.<\/p>\n
